കോക്രോച്ച് ജനത പാർട്ടി (സിജെപി) നേതാക്കളായ അശുതോഷ് റാങ്കയും സൗരവ് ദാസും ഡൽഹി ഹൈക്കോടതിയിൽ സമർപ്പിച്ച റിട്ട് ഹരജി പിൻവലിച്ചു. സ്പെഷ്യൽ എക്സിക്യൂട്ടീവ് മജിസ്ട്രേറ്റിന്റെ കസ്റ്റഡി നീട്ടിയ നടപടിക്കെതിരെയായിരുന്നു സിജെപി ഹൈക്കോടതിയെ സമീപിച്ചത്. കോടതി നിർദേശപ്രകാരമാണ് ഹരജി പിൻവലിച്ചത്.

ഡൽഹി പോലീസ് വാദിച്ചത്, പതിനൊന്നാം തീയതി നൽകിയ പ്രത്യേക ബോണ്ടിന്റെ വ്യവസ്ഥകൾ ഇരുവരും ലംഘിച്ചുവെന്നാണ്. ചെറിയ ബോണ്ടാണെങ്കിൽ പോലും ഇത് നിയമലംഘനമാണെന്ന് ഡൽഹി ഹൈക്കോടതി നിരീക്ഷിച്ചു. ബോണ്ട് ലംഘിച്ചതിനാൽ റിട്ട് ഹരജിയുമായി മുന്നോട്ട് പോകാൻ കഴിയില്ലെന്ന് കോടതി വ്യക്തമാക്കി.

സ്പെഷ്യൽ എക്സിക്യൂട്ടീവ് മജിസ്ട്രേറ്റിന് മുൻപാകെ പുതിയ ജാമ്യാപേക്ഷ പരിഗണിക്കാനാണ് സാധ്യത. സാങ്കേതിക പ്രശ്നങ്ങളില്ലെങ്കിൽ സമാധാന ബോണ്ടിൽ ഒപ്പിട്ട ശേഷം ഇവർക്ക് ജാമ്യം ലഭിച്ചേക്കും. പ്രതിഷേധങ്ങൾക്ക് വിലക്കേർപ്പെടുത്തിയ ജന്തർ മന്തറിലേക്ക് അതിക്രമിച്ചുകയറിയതിനാണ് അശുതോഷ് റാങ്കയെയും സൗരവ് ദാസിനെയും ഡൽഹി പോലീസ് അറസ്റ്റ് ചെയ്തത്.

അതിക്രമിച്ചുകടക്കൽ, നിരോധനാജ്ഞ ലംഘിക്കൽ, സമാധാന ബോണ്ട് ലംഘിക്കൽ, ഔദ്യോഗിക കൃത്യനിർവഹണം തടസ്സപ്പെടുത്തൽ എന്നീ കുറ്റങ്ങളാണ് ഇവർക്കെതിരെ ചുമത്തിയിരുന്നത്. സ്പെഷ്യൽ എക്സിക്യൂട്ടീവ് മജിസ്ട്രേറ്റിന്റെ നിലപാട് നിയമവിരുദ്ധമായിരുന്നെന്നാണ് സിജെപി ഉന്നയിച്ച വാദം.
